Cannabis Regulations in Ohio

Ohio has been undergoing recent updates to its cannabis legislation. Last week, the Ohio Senate voted to approve SB 56, sending the legislation to Governor Mike DeWine for his signature (4). In 2023, voters approved a cannabis legalization law in the state by 57%, but additional legislation since then has been evolving and advancing.

Approved on December 9, 2025, Senate Bill 56 (SB 56) would criminalize cannabis products that have been purchased outside of the state, including those purchased at licensed dispensaries in neighboring jurisdictions, NORML highlights (4). Additionally, the legislation removes protections for consumers from workplace discrimination, sets limits for THC percentages in concentrates for both adult-use and medical cannabis concentrates, and limits the number of retail licenses in the state. At-home growers would be limited to harvesting no more than 2.5 ounces of flower, and individuals who grow more than six cannabis plants at once would face felony penalties.

The new legislation would also limit the sale of hemp-derived products to licensed dispensaries, establish a method for individuals to pursue expunging prior cannabis-related convictions, specifies that adults may consume cannabis on their private property legally, and designates a portion of tax revenue to municipalities that license cannabis retailers, NORML adds.

“I think it’s abundantly clear we need a regulatory structure around hemp and intoxicating hemp products,” Ohio Senate President Rob McColley had stated in October, before the legislation had been sent to the legislative conference committee. “We have some issues to work out, but I’m confident we can work those issues out.”
