Adult-use cannabis legalization will have to wait another day as the Pennsylvania Senate has rejected a bill that was passed last week by the House (1,2). The legislation was heard by the Pennsylvania Senate Law and Justice Committee on Tuesday, May 13, 2025.
“The state acting as a buyer will limit consumer choice and drive consumers out of state to legal markets like Maryland, New York, New Jersey, and Ohio,” said Senator and Committee Chair, Dan Laughlin, to Fox43 (1,2).
The bill also did not receive support from Senator Losa Boscola. “You show me a bill that could pass the Senate, and we can all support, then I’ll be there for you on this issue," said Senator Boscola (2). “I just can’t do it today. I need a better bill.”
Last week after the adult-use legalization bill passed in the House, Governor Josh Shapiro commented (2), “Nearly all of our neighbors have legalized adult-use cannabis — and while we sit on the sidelines, we're losing out on millions in revenue and millions more in economic activity. It's time for us to catch up. The Pennsylvania House took an important step to create more economic opportunity by passing a bill to legalize marijuana.”
Senator Marty Flynn expressed during the Senate Committee meeting (3), "As people move out of the Keystone State, year in and year out. As we're the last to come to this important issue. All our neighboring states have already done this. Ohio did it. So that lets you know where we're at in Pennsylvania when it comes to new revenue sources to budget a $2 billion deficit, it's time we get this done." Senator Flynn further added, "If you go to Franklin County, if you go to Armstrong County, you go to Philadelphia County, the majority of people want to see legal marijuana for adult use. That's what the polls say. So it's time we in the Pennsylvania Senate, do what the people want. And I know it's a huge process, but naming bridges gets old. Let's do something."
Had the bill passed in the Senate, HB1200 would have legalized cannabis in the state for adults 21 years old and older and additionally would allow for cannabis sales in state-operated stores (4,5).
Pennsylvania will have to wait a little bit longer to join its neighboring states in adult-use cannabis legalization.
